DiskD Terms of Service
These Terms of Service (“Terms”) are between DiskD and you, the (“User”). This Agreement sets forth the terms and conditions of use of DiskD Services.
By using the services offered by DiskD, User agrees that you have read, understand and agree to the terms and conditions set forth by the Terms. The use of DiskD’s services is dependent on Users acceptance and compliance with our Terms.
DiskD reserves the right to revise these Terms at anytime by posting updated Terms on www.DiskD.com. You further acknowledge that the continuation of use of the DiskD services constitutes your agreement to any revisions.
Services
DiskD Services provide the User the ability to transmit files to valid email addresses by storing the file on a secure DiskD server and providing a link to the email recipient that allows access the file. The file can be then be retrieved and downloaded by the recipient. User is responsible for any files transmitted by DiskD. DiskD may also provide the User the ability to store files on servers provided by DiskD.
Account Data
User is fully responsible for maintaining the confidentiality of any DiskD account information, including passwords. User is also responsible for all content and information stored, transferred, and received under your username and password. If you suspect a person has accessed your account without authorization, it is your responsibility to change your password and alert DiskD immediately in writing. In addition, you acknowledge that DiskD may communicate with you through email. You are responsible for ensuring that DiskD has your current email address so that DiskD can provide you such communications.
DiskD does not own any data, information or material that is stored in User accounts. DiskD cannot be held responsible for the contents of User accounts. We will not disclose any information regarding Users or User accounts, including any data, without Users prior permission except in accordance with this Agreement. DiskD may access your account, including its data, to respond to service or technical problems or as stated in this Agreement. User shall have sole responsibility for the integrity of all data stored in your account. Furthermore, DiskD shall not be responsible or liable for the deletion, correction, destruction, damage, loss or failure to store any data.
Limitations of Use and Liability
By accepting these Terms, User is solely responsible for the content of all data stored or retrieved from User account. User agrees to abide by all applicable local, state, national and international laws and regulations in connection with DiskD service. User agrees not to transmit or store any files that contain any content or material, including audio, text, graphics or any other data that could be considered (a) racist or defamatory; (b) threatening; (c) a violation of any person or entities rights or privacy, including, but not limited to intellectual property rights; (d) copyright infringement; (e) pornographic or obscene; (f) promoting unlawful conduct; (g) unsolicited junk mail, spam or unauthorized content; (h) containing any viruses or code that could be considered harmful or disruptive to services; (i) disruptive to network or servers connected to DiskD’s services. DiskD reserves the right to define and prohibit “unreasonable burden” by User on the servers or DiskD’s service resources.
By becoming a DiskD User, you acknowledge that DiskD cannot be held accountable for any and all technical errors, including loss of User files or any data stored by DiskD. Under no circumstances will DiskD be held accountable for any loss of customer data. DiskD does not provide any warranties respecting its services.
You agree to indemnify and hold DiskD harmless from and against any and all claims, costs, damages, losses, liabilities, and expenses (including, but not limited to legal fees and costs) resulting from or in connection with your use of DiskD services or violation of this Agreement.
DiskD is not responsible for circumstances beyond its control, including without limitation actions of other Users, third parties, Acts of God, or natural disasters. DiskD's responsibility to Users shall be limited to the amounts actually paid by such user for DiskD's services, and shall not include damages of any type arising from the connection with DiskD services or any third party connections.
Third Party Usage and Limitations
All transactions using DiskD's services are between the User and third parties that the User has identified as senders, recipients or delegates. DiskD is not an agent of the parties involved in any transactions using DiskD services. Any such activities, and any terms associated with such activities, are solely between the User and the applicable third-party. DiskD shall have no liability, obligation or responsibility for any such correspondence, purchase or promotion between the User and any such third-party. Should the User have any problems resulting from the use of any third party services, or should the User suffer data loss or other losses as a result of problems with any of the Users other service providers or any third-party services, DiskD will not be responsible. Unauthorized use of the DiskD service, or the resale of DiskD services without our prior written consent, is expressly prohibited. User shall not copy, distribute, sell, transfer, publish, or transfer your license to our services in any format to any third party.
Third Party Sites
DiskD may make available links to third party sites. DiskD does not endorse any sites on the Internet that are linked through DiskD and cannot be held responsible for any content, products, or other materials on or available from such sites.
Payment of Fees
DiskD reserves the right to revise fees for any services at any time, upon thirty (30) days prior notice to User. User is responsible for ensuring DiskD has current contact information on file at all times.
Refund of charges
When users cancel their account, they will not be issued refunds for recent or previous billings. Annual subscribers who wish to cancel and request a refund may do so within 30 days of the day on which they were charged for their account. They will be refunded the amount of their purchase minus an administration fee of $9.95. Other requests for refunds may be processed at the sole discretion DiskD.com management.

Cancellation requests sent via email to contact@DiskD.com will not be processed and will be replied to with an automatic response. You must sign in to your account and request cancellation for it to be processed in a timely manner.
Termination of Services
User may terminate your user account upon notice to DiskD at any time. Upon termination, User is responsible for acquiring all saved information belonging to User from the DiskD servers. User may request, in writing, a file of your data, which DiskD will provide for a fee within 30 days of said request. DiskD reserves the right to suspend or terminate without notice User password, account or use of DiskD service and delete any data within DiskD service if User fails to comply with these Terms. In addition to other termination provisions, Quick Share and Trial Account Users with free accounts are subject to termination if the User account is not used for a period of sixty (60) consecutive days. Any data stored will be lost upon account closure. In the event that DiskD terminates data storage services, DiskD users will receive the option to have their stored files sent to them in CD or other format selected by DiskD. DiskD does not guarantee length of service and reserves the right to suspend or terminate services without notice.
